In a previous post I discussed a key flaw in the US Constitution.  The Framers anticipated that the citizens of the new Representative Democracy would elect the wisest people to represent themselves, thereby nullifying the inherent negative characteristics of Pure Democracy.  Instead the citizens tend to elect representatives who are the extremes of their own character flaws, thereby creating a Pure Democracy by proxy.  The people elect representatives who are most likely to give them the most government pork, and who represent their own irrational fad thinking.  In this post, I will briefly discuss a second key flaw in the Constitution, which is the lack of oversight on the three branches of federal government.

The federal government lacks substantial oversight.  Compare it to a high stakes professional football game with a sound set of rules, but no referee.  How can that work?  The players and coaches will abuse the rules every way they can.  Penalties will not be enforced.  Ball placement will become extremely difficult.  Close calls will be resolved by fist fights.  No one will get kicked out of the game for being excessive.  The only real enforcement will come in the form of the threat of rioting from the crowd.  That is Representative Democracy.  There must be a referee with the authority to enforce the rules, otherwise the only rule of law is the outbreak of violence from the crowd.  In the case of Representative Democracy such an outbreak occurs at the polls at the next election when the voting citizens replace the representative with new representatives.  The new representatives generally act like the replaced representatives because of the nature of un-refereed government.

The simple and obvious solution to this flaw in our government is a referee of sorts.  I’ve written about this before.  A Reeve of the Constitution is necessary if the rule of law is to be enforced on the lawmakers.
