UPDATE Sept. 26, 2009:  I added another article on the traditional legal aspect of “all men are created equal.”  See  About “All men are created equal” and natural law.

As I mentioned in an earlier blog entry, the phrase “all men are created equal” has its origins in studies of the failure of Rome.  Rome had a number of classes and it had different laws for different classes.  This created a tangled web of laws that strangled the Roman republic.  The Founders understood the problems associated with this, and when they began forming their new government, they included the idea of a classless society in the Declaration of Independence, and in the Constitution.

The idea of equality is really the idea of being classless.  Having different laws for different classes is a bad idea.  The problem of classes wasn’t so much the problem of one group of people being better than another.  The main problem the Founders were addressing was the problem of government being strangled by excessive laws.

The Founders intent was to try to prevent overly complex laws because they are destructive to social order.  Let’s look at what we have today.

We have a graduated income tax.  The levels of income define classes.  Different rules are applied to different tax classes.  This has created a situation where the typical US taxpayer cannot complete their tax forms without the use of a computer.

We have different classes for different sizes of businesses.  For example in my state, Oregon, we have a law that only applies to restaurants with over 14 locations nationwide.[1]  This creates two classes of restaurant.

We have hate crime laws that apply laws to only certain groups of people.  One such law,  H.R.1913, labeled “Local Law Enforcement Hate Crimes Prevention Act of 2009,” not only violates the principle of no Federal government control of local  government affairs, also violates the principle of having a classless society.[2]

More examples turn up every time we look closer at governmental laws.  Each class-based law adds to the complexity of government.  We continue to become overly regulated.  We are slowly strangling on our own laws.

When our Republic is no longer guided by our founding principles, and is instead guided by government regulations based on practices with a long established history of failure; when we metamorphosis from a nation of founding principles embodied in just laws into a nation of laws based on lust for power and a history of failure, we become a fascist state.  Barack Obama, Nancy Pelosi and comrades must be replaced.  The people replacing them must be people who understand America’s founding principles.

Sarah Palin is one such person.  I hope to hear much more from her in the coming years.  I hope to see America wake up and throw off the gradual growing oppression of unjust and destructive laws.  I hope to see America once again enjoying the just and God-given natural freedom, instead of the unjust freedom as permitted by the current American fascist government.
